Legal Question in Family Law in Kansas
My wife has a child with another man. Neither have custody although we were told by a lawyer that my wife has physical custody because the child has lived with her his entire life. The biological father has now told us that he is getting a judge to rule that we are not allowed to move back to our home state after I am done in the military. The bio father is in arizona with the military himself and not in kansas with us. Are we at risk of not being allowed to move back to our home state were all of our family is?

The other man may be able to get an injunction to prohibit the move, but, they are very rare. If the mother is moving for work or to be near family, then few courts will prevent the move. But, the mother may be responsible for the extra costs of af transportation of the father getting his visitaiton time.
