Fired and Wanting to File Suit
While on FMLA leave due to a personal injury, I was
terminated from my job. I have contacted a local
attorney and I received my first invoice for services.
It was $285. I am unemployed and am still suffering
from my injury. I believe that the FMLA act is
wonderful, but it is definately not fully enforcable
for most. I have a great case. I have kept very good
records. I have educated myself very well. I cannot
afford $250 per hour to persue this. I desperately
need some suggestions. My attorney has not suggested
that I file a complaint with EEOC or any other state
office and I am concerned that I may go over my time
limit. PLEASE...Someone give me some sound

If you were fired in violation of the FMLA you do not need to file a charge with the EEOC or any state agency. You can file a complaint in federal court without any preliminary requirements. You will need an attorney to do this, however. If you have a valid claim you should have no problem finding an attorney who will represent you on a contingency fee basis which means that the legal fee will be paid out of your recovery with no up front cost to you.
