Legal Question in Civil Litigation in Kansas
Borrowed Property
When my wife was pregnant last year her sister gave her some maternity clothes to borrow (their parents are witness to it being a borrow situation). Didn't really want, never used, just put in a closet. We live in IN, sister lives in KS.
My wife and her sister had a falling-out a few weeks ago. No mention has been made of the return of the clothing until today. Sister is now demanding the return of clothes, or payment for the value of them, by the end of the month. She claims value at $500. Most likely that was retail cost 3 years ago, not current market value. Sister refuses to pay any portion of shipping for return.
Wife and I will be in KS at the end of next month. Sent message offering to deliver clothing then, have received no response.
Is there any legal recourse she has at this point? Would filing theft charges against us be an option for her, or a civil law suit seeking monetary compensation? Basically, does she have any other option in the next month and a half but to wait it out?
