Legal Question in Civil Litigation in Kansas
I got a divorce a year ago and it is in the divorce decree that my ex husband is to reimburse me for property taxes and insurance that I paid on property that he got out of the divorce. He was also ordered in the divorce decree to pay some back income taxes. He has paid none of this. Can I take him to small claims court to try and get a judgement out of him and in what county do I file. I live in a different county now than he does and I am the one that moved from the county where we were divorced in.

It your decree was entered, even if neither of you still live there. But, from a practical standpoint, it might be best to bring the case in the county in which he lives.

You can sue your ex for contribution if he was ordered to pay these sums. The general rule in Kansas is that suit is brought where the defendant resides. However, if you can show he has substantial contacts with another county, such as the county where the decree was entered, that is an option.
