Finger in conveyor belt at grocery store

My 4yr old daughter got her finger caught between a guard and the conveyor belt, causing bruising and sweeling. We took her to the emergency room in order to check for broken bones. The insurance company of the grocery store will not pay the hosptal bill. Is there any legal action that I can take?
