Legal Question in Civil Litigation in Kansas

legal representation required?

We are involved in a situation where we are being forced to defend our adoption contract. Because we are a non profit and therefore a corporation (two people) the judge told us we have to have an attorney and cannot represent ourselves. In so many words he said that if we didnt have one we would just lose the case. Is this true? Where can i find the statute that answers this question one way or the other? We did not file the case, it was filed against us to keep us from getting a judgement in our county to reclaim our dog. The goal of the woman and her attorney seems to be to tie things up until they break us financially, which will not take long since we do not have any income.

Re: legal representation required?

It does not always make intuitive sense, but the Judge is right. A corporation is a seperate person in the eyes of the law. It is not you nore your co-shareholder. Unless you're an attorney, you cannot represent another person in court.

If the Corporation does not have an attorney to represent it in court, in this lawsuit, the other side can win by default.
