Legal Question in Civil Litigation in Kansas
Small claims: Johnson county kansas
I was purchasing a truck from someone with the agreement that I had time to reasonable time to pay it off. On june 14 the keys were given to me for 1000.00 with the agreement that I would pay rest at end of month beginning of next meaning july on july 4 I gave the individual a check for 1000.00. A few days later the individual contacted me saying his bank contacted him and sent check back for him going against thier policy with atm deposits after speaking with bank and after the check was sent back I gave theguy a cash for 900.00 because I miss counted and he was in desperate need for cash on july 15 he sent me a text asking when he could get the rest and I informed him I would have it on friday the 18 but he then gave me a sad story of how he needed the funds cause of over draft so I said I will see what I could do when I got back to town which was not till wed night then Thursday night the party came and took the car with no notice no warning and no call I reported it stolen. After it was found that they took car they are refusing to refund money paid. I turned insurance off of it and asked for belonging out including house lock keys. I don't car about getting car back . I just want a refund on money paid. Since there was just an agreement with no specific date just an understanding that I wouldn't drag it on for ever. Im just curious of where to go from here and file a small claim for refund. And process and what to say on paper work.
