how do i sue someone in another state

hi. i purchased a diamond from someone off ebay. the description was not even close to what i recieved and i had it appraised and its value is worthless. the problem is i live in california and the seller lives in kansas. what do i do? can i sue from here? if i have to travel can i sue for the cost of the plane ticket and can i also sue for the filing fees?

You will have to find an attorney in Kansas, explain the situation and then see what happens. You will not be able to recover flight expenses in the event you have to go. However, the Kansas attorney can best advise you.

You may sue the seller in Kansas, and perhaps in Missouri. Either would be a state court action. You did not say, but I doubt that you paid enough to be able to sue in federal court in California. Probably your best recourse is to go through ebay, to see how they might help you resolve the problem. because, if you sue in Kansas, you probably would not get reimbursed for the expe4nses you described.

I do believe that e-Bat does have policies regarding misrepresented merchandise, and simply not accepting merchandise, as well as changing ones mind. Check out their internal policies, but do it promptly. It's a lot easier than suing.
