Legal Question in Civil Litigation in Kansas
Tanning Contract
I was having an allergic reaction to a Mystic tanning bed. I went to the doctor to get a note and she told me to discontinue product. I'm locked into a two year agreement and they won't let me out of it. Doesn't having a doctor's advice mean something? The lady I talked to on customer care said that they would need to know exactly what it was that i was allergic to but when I called my physician she said there is no way of testing that all she can do is ask questions.

Re: Tanning Contract
If you are having a bad allergic reaction to their product or service, it may be defective. If it is defective, your may be entitle to compensation. That could stop their business. If this scenario looked plausible, they would take your complaint more seriously than you say they are now.
But, in order to prove that their product or servcie is defective you would need to show, among other things, that you are injured and their product caused the injury. If you beliee that your allergic reaction is to the tanning products/service, and your doctor is unsure, than you may need to get asecond medical opinion. You said that yoru doctor wanted to ask qyestions, but your did ot say what type of questions. Perhaps what your doctor meant was that he would need to do more investigation to determine if the tanning process was causing your problem.
