Legal Question in Immigration Law in Kansas
does marriage stop deportation?
My boyfriend was arrested but files were dropped he still has a BICE hold. He has been here for greater 10 yrs. We have a 3 yr old together and expected a baby next month.
We live in Kansas with is a common law marriage state. Would that help or actually getting married help? What are his chances of staying here since charges were dropped?

Re: does marriage stop deportation?
It would depend on what charges and which was the disposition from the court. Sometimes, certain dispositions can still constitute a conviction for immigration purposes. You will need to find copies of his docket sheets from court and have an attorney review them. Feel free to contact me if you would like to discuss the details of the case privately.
