Legal Question in Immigration Law in Kansas
what qualifies illegal immigrants to demonstrate that time apart from an American spouse, would create extreme hardship? my husband was told by a lawyer in November that we probably wouldn't qualify for cancellation of removal since I have no major health problems and have a good job. I am worried that if he does voluntary departure he will be stuck in Mexico for a long time. Will new law in affect March make a difference in ability to qualify for extreme hardship
1 Answer from Attorneys
It is difficult to prove hardship for purposes of Cancellation of Removal. I suggest getting a couple more opinions from experienced Immigration Attorneys in your area, who have practiced in the area of Removal.
The new law that you refer to applies to people who are not out of status and who are not in Removal Proceedings.
