Legal Question in Insurance Law in Kansas
I hit a parked trailer and it was dark and no reflectors
I hit a trailer last night that was ''legally'' parked, but was an illegal trailer. It totaled my car, which only had liability insurance. It belongs to a contruction crew and was an 8 1/2 foot trailer on a 23 foot road. It was in a very dark place, it was black, and loaded with an old baseball backstop. It had no reflectors, tags, or tail lights on it, and it was at the top of a small hill and I couldn't see it. Are they responsible? I just want another car. My injuries are minor, but my car is a total loss.

Re: I hit a parked trailer and it was dark and no reflectors
If it did not meet the legal requirements for being on a public thorofare, it constituted a hazard and obstruction to traffic, rendering the person who placed it there liable for damages or injuries caused by it. No tail lights would seem to fit the defintion.
