Legal Question in Employment Law in Kansas

Is this consider Discrimination?

If you are hired at a company and they have in their handbook that you can not apply for a different position or promotion until you have been there 6 months, when a position you wanted was opened up. Then a year goes by and a new girl is hired and they promote her with in 4 months of being there. Is this considered discrimination? I wanted to apply for this supervisor position but they told me that I hadn't been here long enough. And now it seems like those rules didn't apply to this other person. Can you help?

Re: Is this consider Discrimination?

The basis for discrimination (among others) are race, religion, nation of origin, physical/mental disability, and sex [gender]. If the difference between you and the girl that got promoted, fits into one of these, you may have a case. But, you do not have very long to raise it, so do not wait long.

Find an attorney in your area, who handles employment cases, and tell them all the facts of your situation and answer their questions as truthlfully as you can. Then, you should have a good idea as to whether you have grounds for a claim of discrimination.

If you are a male, then you might have something. If you are female, you probably do not.
