Dismissal from associate chiropractor position
Dear Lawguru,
My sister recently was dismissed
from her position as an associate
chiropractor three weeks before the
birth of her child. At first the owner
of the office said it was because she
was going bankrupt and was unable
to keep her on, but then she came
back and said on three different
occasions ''I didn't know you were
pregnant when I hired you''.
She then proceeded to tell her that
she would not be able to pay her
salary on time and that she would
get it to her sometime soon.
When you call the office to set up an
appointment, the office staff says
that ''she is on maternity leave''
even though she was fired without
benefits.
She only worked at the office since
December of 2006 and was
dismissed 5/15/07.
What legal course of action can she
take regarding this situation? Thank
you for your assistance.

Your sister needs to contact an employment attorney. If what you say is how things happened, then there is probably a violation of the law. I am guessing this is a small office, so it is probably a matter of the Kansas Act Against Discrimination and not federal law. You need to have her call an employment attorney.
