Legal Question in Employment Law in Kansas
Traveling Expences
I would like to know my husband company is based out of one town and he is required to work 3 hours from our home and his employer's address. Can his employer require him to pay his hotel expences and not pay him per-diem, even though he is paid union wages?

Re: Traveling Expences
The issue largely depends on whether he is an hourly employee entitled to minimum wage and overtime protection, or an exempt employee under the Fair Labor Standards Act. There are not enough facts to make a reliable determination. The union contract might also have some control over this answer. Please feel free to contact me for a free discussion, or check out the Department of Labor website on wage and hour laws. 1-866-385-6244 (toll free)
