First check what your lease agreement says about early termiantion. In most cases, that will rule. If you have field for a restiraining order for the leased premises, it was granted, and the ex partner violated it, it will help your cause. If they have not violated the resraining Order, then you will have little option but to pay the early termination fee., or make the leasor whole. If you have not even requested a restraining order that includes the leased premises, then you have no grounds to escape an early termination fee or penalty.
Good luck
