Legal Question in Personal Injury in Kansas

Hit and Run Accident

Is there any time limit on how long you have to report

an accident to your insurance carrier. A teenage boy

rear ended the back end on my husbands pick up they

exchanged names and numbers, my husband agreed to not

call the cops because the boy begged him. The boy was

suppose to keep in touch and pay for the repairs and

of course he did not. It took us 6 months to track him down can we now file with the insurance since he

did not follow through on his part of the deal?

Re: Hit and Run Accident

The terms of your policy provide for a time to report - generally about 90 days, but some companies accept reports outside this time. Make your claim anyway. If you have a problem with your insurance company you can always sue the boy or if the kid is under 18 the boy and his parents.

It might be a good idea to sue the kid. Teach him about responsibility.
