Legal Question in Personal Injury in Kansas
I recently was in a car accident. A car rear ended me and another car rear ended that car as well. I got the information and insurance from both cars but I seemed to have lost the information from the last car. The lady who hit me didn't have any visible damage from the car who hit her so she didn't get down their information. I contacted the insurance from the car who hit me and they are refusing to pay. The lady who drove is now saying that she didn't hit our car; the car behind her hit her and she hit into our car. Therefore, her insurance is saying that since we cannot provide the information from the 3rd car, they are not going to pay, since it wasn't her fault. I was wondering what we can do about this now? I mean, her car physically hit our car. It should be HER responsibility to get the information from the car who hit her. And since there is no damage on her car, she could just be lying about the 3rd car even hitting her.

Hopefully, you made a police report. It should identify the 3rd driver. In Kansas your insurer takes care of yrou car, then often THEY go after the other driver. Your insurer will assist you in going after the other driver. If you did not make police report, then you may have a proof problem. You may need to sue the driver that hit you. If car 2 had no rear end damage, then they will have a hard time proving tht they were hit from behind, pushing their car into yours. If they think they can show that, they will add driver 3 to the law suit, you cn then amend yrou paw suit to add driver 3. You may need to hire counsel to handle this for you.
