Legal Question in Real Estate Law in Kansas

When i was 16 i got charged with possesion of oxy codon. We filed for the paper work to get me on a diversion. The diversion did not go through until about 7 months later. Then a few weeks after the diversion when through (now 17) i was with my friend when he stole about $50. When he got taken into the police station he said i was with him and that we did it together. When i got taken in i refused to talk without my lawyer and they let me go. They have evidence of someone seeing me and video tape of us turning the money in at a bank. So i went to the people that the money was taken from and apologized and returned the money to them. They said that they did not press charges but they filed a report. and they said they would talk to the police to see what they could do about dropping the charges against me. Also, our District Attorney is about 1000 cases behind schedule and may not want to deal with a case involving $50. I'm wondering what are the possible scenarios of what is going to happen to me? Thank you

If you made full restitution to the victim, it is unlikely that you will be vigorously prosecuted. But, they may seek to have you testify against yoru friend. As to yrou diversion, you have not yet been convicted of the theft, so you may nto have violated yrou diversion agreement. But, if you are convicted, you can be brought in to show cause why your diversion (probation) shoudl nto be terminated, and serve the jail term for the possession case. If the prosecutor or the police contact you by telephone or mail, consult direclty with an attorney in your area before saying anything other than for them to wait for a call from your attorney.
