Legal Question in Real Estate Law in Kansas
After divorce for 4 years our son who ended up with the house, is trying to get his ex and her father off the mortgage note and even after the ex signed a quick deed release, the bank holding the note will not remove them. They have not paid anything on the note. How can he get them off the note?

The lender is not bound by the Divorce decree. The best way to remove the other people from the loan is to pay off the loan. The next best way, is to refinance the debt, (in just his name,).He needs to be careful, not to be delinquent on payments, as he would be liable to his ex, if the lender comes after her for past due payments.
