We have a lease with our landlord, back in April-02 a huge tree fell on our house, of course, damaging the roof and other parts of the house. The roof was finally repaird in June-02 but the rest of the repairs have not been looked at since. There are still huge holes in the house, we have lived here and paid rent without causing any problems about the repairs. Its been months and the repairs aren't done. We told our landlord we were moving due to this....we can't live in a house that has holes going outside...Are we within our rights? We have small children and with holes in the house we have bugs coming in and birds living in the attic. Our A/C runs nonstop due to the holes. We can't live like this any longer.

Based upon the limited information you have supplied, it sounds like you are within your rights to terminate the lease and vacate without owing more rent. However, there may be provision within your lease, that change that. Without knowing the contents of your lease, and the form and content of your dealings with the landlord.
