Legal Question in Real Estate Law in Kansas

Can a Lis pendens be placed on a clear property while a mortgaged property is being foreclosed? Should it only be put on the property involved in the foreclosure action? I need to sell the clear property but an attorney have placed a lis lendens on my clear property because a foreclosure has a possibility of summary judgement. I still have time to answer the suit and when trying to sell the clear property to get funds to settle the foreclosure, I found the lis pendens. Seems very unfair to cloud the title of an property not involved in the foreclosure.

You may be able to successfully get eh Liz Pendens quashed. You probalby should only attempt this through legal counsel.
