shared property

my brother came into a large sum of money(insurance policy),he has a 12 yr. old son with him,,he met a woman and moved to kansas,she has a son also,anyway,,,my brother paid off her home,remodeled it in and out,brand new applainces,new furniture in every room,,bought her a cadillac,,bought her son a truck,,bought a new camper,,they broke up,his name is not on the deed although he paid it off,,she kicked him and his son out,,told him he can keep the truck he bought for himself and the camper,,thats all,although he bought everything else,,,what is he really entitled to??,,he has no receipts,,she kept them,he also bought her an engagement ring which she kept,,he spent nearly a quarter of a million dollars on her and her home,,he thinks that since she did not put his name on the deed he is not entitled to anything,,the truck and the camper combined a total of 63 thousand dollars,does he has a leg to stand on or did he leave with what is considered half..she said that even thou he paid off the house for her,,it will be considered rent for the past 2 years.please help,,he feels so used.

They say that "love is blind" and your brother is certainly proof of that. If I had to imagine a more difficult situation in which my client did almost eveything wrong, it would be hard to top this one.

I don't mean to be so harsh but he spent all this money and didn't keep secure possession of the recipts for things he paid cash? If he paid by check, his bank would have records even if his own are lost.

He has a right to fair reimbursement of the value of things he gave to his girlfriend perhaps with the exception with things that wre clearly gifts such as jewelry, etc. But having rights and being able to prove the basis for these rights are two different things.

Even though they never married. issues like this are often covered by Family Law. Your brother should consult with an attorney with experise in this area and see if there's any way he can make a case for himself. The longer he waits, the more difficult it is likely to become.

Your brother has huge troubles. If any of this took place in New Jersey, call me. If it all took place in Kansas, call a lawyer in Kansas and be prepared to pay that lawyer for his time. Your brother should not give up, but be ready for some real fighting. I am at 973 890 0400.
