My 18 year old daughter is away at college this year, she previously lived with my sister and her husband for a few years . Recently she was home for the weekend and my sister gave my daughter her debt card to get gas, she's used her card several times before . Anyway, my daughter filed her own taxes she made enuff money, my sister's husband has intercepted my daughter's income tax check and they are trying to force her to sign it over and give them $1100 of the $1300 she got back demanding she owes them for claiming herself. They are wanting repay ed for all sorts of rediculous things that were never mentioned before . They are threatening to file a police report for some items purchased for school at Walmart now . My question is 1. Can they do that, if so what will happen ?
2. What can she do to get her check from them ? She really needs her money to get by.
What do you suggest she do to resolve this the easiest way possible . She does owe them some money $300. She acknowledged and plans to pay that but they are being totally unreasonable . Thank you I hope you can help guide us to handle this properly .
Sincerely ,
Jamie Houck

You daughter should call the IRS to request a replacement check. She can call 800-829-1954 and either use the automated system of speak with an agent. The IRS should issue you a Form 3911, Taxpayer Statement Regarding Refund, to get a replacement check or you can download the form from the internet. Please feel free to contact my office (855-376-3785) should you need further assistance.
