Legal Question in Traffic Law in Kansas

handicap parking

my car broke down at 8p.m. myself and a 70 year old man pushed it out of the drive to a filling station to be out of traffic we pushed it straight back the bread store was closed when i went to tow the car home the next morning at 7a.m. there was a ticket on it for parking in a handicap spot there was another spot right next to it even though no one would use either one is this a proper violation ? i dont think 2 old men could have pushed it further im not handicaped on paper but i do have diabetes and liver disease and havnt worked in over a year this fine is a definite handicap to me being out of work and no income your advice would be helpful thank you

Re: handicap parking

If you did not drive the vehicle there, then you may do best to tell the Judge that the car ran out of gas, and your rolled it to the only spot you could. You came back to get it as soon as you could, but had gotten ticketed in teh meantime. Perhaps the Judge will be lenient with you. You don't seem to have a defense to your care being parked in a handicap spot.

Good Luck
