In Kansas, a conviction for a second Driving While Suspended is a Class A misdemeanor which carries a minimum of 5 days to a maximum of one year imprisonment and a minimum fine of $100.00 to a maximum of $2500.00. Actual sentences vary amongst state jurisdictions, so I would need to know the precise court the defendant is in to give a more specific answer. Also, your drivers license can be suspended for 90 days on top of any existing suspension. Penalties are more severe if the driver was DWS because of a DUI at the time of arrest; a 90 day minimum sentence is mandated. I suggest you do not plead guilty.
