Legal Question in Traffic Law in Kansas

hello, I got a situation right now with a traffic ticket. I got cited for an unsafe lane change. I was at a red light needing to get into the right lane. I put my blinker on and looked to pull into the lane. I see the white caddilac coming and im asuming it would see me and slow down, so my car is currently half way into the right lane with my blinker and the light turns green. The Caddilac continues at the same speed and didnt slow down. As i realize she wasnt slowing down i try to pull back into the left lane but was too late and got rear ended. Can i fight this unsafe lane change?
