Legal Question in Traffic Law in Kansas

vechicular manslaughter

Last summer a relative of mine was killed in a vechicle accident, at which he was not at fault. It was proven that the other man, who hit my relative, was failing to yield. The collision resulted in the instant death of my relative. My question is, ''If a person kills another person accidently by not following the law, such as failure to yield, can they be charged with vechicular homicide?'' The county attorney working on the case knows both families involved, should she resign from case? Also, there are many discreptancies in the other man's testimony. It seems to me, that if a person kills another person, even by accident, while failing to obide by a law, that they should be held responsible for that person's death, and not just the failure to yield violation. I wondering if I am right .

You may be correct. Perhaps the prosecutor should call for an independent prosecuting attorney to take the case. You might suggest this to the prosecutor or the powers that be in that jurisdiction.
