Legal Question in Veterans Law in Kansas

va disability

I was discharged in 2000 after returning from Kosovo I was told that I had chronic back pain and a severe personality disorder. In 2003 I was informed that I could file for disability benefits which I filed for my back and was awarded 40% in 2007 I was told that a borderline personality disorder was a scam to go get evaluated. I did, 50% PTSD combined rating 70%, IU 100% I am now and have been fighting for an increase in my back as I have got much worse. Can I get back pay for the PTSD that was misdiagnosed and can I get retro to injury date on my back or just filed date.

Re: va disability

it looks like you are fairly fortunate as far as benefits go. Effective dates are generally based on the date the VA received the claim. For the other questions, I think an attorney would need to review your file. There are some good veterans lawyers in Kansas. You may want to confer with them for further advice. Check out the National Organization of Veterans Advocates website. Good luck.
