Changing the name of my child

When my child was born I gave him my last name, I was not married. His father threatened to take him away from me if I didn't change it to "his" last name. He told me he would see to it that I never saw him again. So I changed my child's last name to the same as his father's. Since then, his father has only seen him one time (that was when he was 1 month old). My child is now 4 1/2 years old and has no clue that he has a father. He goes by my last name, but all of his legal documents have his father's last name. I have never married, but I would like to give my child my last name before he starts school. I was wondering if that is possible without marrying. And if not, how old does he have to be to make the decision to change it himself?

You can apply to the court for a new name for your child. Based on your facts you should not have a problem. Under the circumstances your child would not have to give consent.
