Legal Question in Wills and Trusts in Kansas

Can I get my dad's remains from his girlfriend? When he died he was cremated and his girlfriend at that time kept his remains and won't give them to myself or any of my sisters or brother. She has since his death married another man. She still refuses to give our family the remains.

Since she was not married to your Dad, she has no basis to deny you the return of the remains, unless his will gave them to her. But, if she paid for the cremation, she may require that yu reimburse her. If she refuses the demand from your attorney, you may need to sue her and her new husband.
