Legal Question in Wills and Trusts in Kansas

Fathers Estate/Structured Settlement

Hello,

My Father recently passed away. He has a structred settlement payment (somewhat substantial) due sometime this spring from a head injury. The company where the accident occured has since went out of business. He left no paperwork behind and the lawyer who represented him will not return my calls. I am still paying off his funeral bill 6 months later and Im not sure what step to take next.

Re: Fathers Estate/Structured Settlement

It sounds like an estate needs to be opened for your father in the probate court. His prior attorney has not authority from the probate court to discuss his affairs with you. The executor (personal representative) of yoru father's estate would get the authority to discovery his assets.

Anderson & Price P.C. have had cases simlar to yours. They are on Roanoke Blvd in KCMO, but practice in KS too.

Good Luck
