Legal Question in Wills and Trusts in Kansas

My husband died recently. He and his brother owned a lot in town in their names only. We had a will that left his possessions to me. Do I have to probate the will in order for his brother to sell the lot. We live in Kansas.

A "will" is just paper until a probate court deems it to be the last will and testament of a decedent. You may petition the court to have your deceased spouse's assets transferred to you. It will take some time, (maybe longer than putting the will through probate), but can a,lso get ti done. If the totla amount of items you husband owned at the time of his death (minus the stuff that automatially went to you) is low enough, you may be able to do a small estate affidavit, in place of probating tghe will.
