Legal Question in Wills and Trusts in Kansas

legal rights of children and reading wills

Do my children who are in their twentys have the right to see a copy of their deceased fathers will?

Their stepmother will not let them read it or have a copy. What legal rights do they have?

Re: legal rights of children and reading wills

Wills and probate records are public information and anyone may view them whether they are a beneficiary of the estate or not. Although stepmother is not compelled to communicate with them directly, the records will be available at the courthouse for the county in which their father was a resident at death. If stepmother has not yet opened probate for father, your children may initiate the action. If that is the case, your children should retain a lawyer who does probate in that county.
