Legal Question in Wills and Trusts in Kansas

how long can it take to resolve an estate

our sister died in may of 2003. She had raised one son who was not adopted by her. we have left the matter of her estate for him to handle because of location. before leaving kansas the family more or less divided up the estate. we haven't heard anything from him. there was property sold as well as stocks and bonds. we didn't retain a lawyer for we felt such grief to have lost her, that everthing else would work itself out. how much longer do we have to wait for any distribution or contact? should i be worried the stepson has other ideas than the ones agreed upon?

Re: how long can it take to resolve an estate

Creditors in Ohio in 2003 had one year to file claims against the estate. So if the step-son were waiting for that period to end, then it may be that long before he does anything. Normally, it would be done in about 6 months-12 months. You should contact the probate court in the county where she resided and ask if anything has been filed yet in her estate. Many counties are online and you can search with her last name. I would be concerned.
