Legal Question in Wills and Trusts in Kansas

Mom Died Without A Will

My mother died recently with no will. She was divorced with (2) grown children. My father owned her home and acted as landlord. All of her debts are paid (except for her recent hospital bills, which will be covered by her Blue Cross and Medicare). What is left over is a car worth about $3,500.00 titled in her name only, a checking account which is currently overdrawn due to the fact that Social Security pulled her final check out and are holding it until an estate account is established, and finally a possible tax return which could not possibly be more than $2,000. Can my brother and I handle all of this without a lot of legal expense? Are there forms we can file on our own, since her whole ''estate'' is worth much less than $10,000.00? I thank you in advance for your help.

Re: Mom Died Without A Will

Yes - You could probate your mother's estate without much legal fees. Contact the District court in which your mother lived/died. They can explain your lesser probate options to you.

Good Luck
