Legal Question in Wills and Trusts in Kansas

Parents land and will

Mom died in oct. While in a morphine coma, my brother from Az. had my Dad through hospice have my mom sign 1/2 of their land in Az to my brother. My parents both had 2nd stage alhtimers. I have taken care of them for 10 years now. I didn't know they were diong this. Is it legal, when my Dad should have gotten moms land. Also brother is trying against Dr.s order to take dad to vacant land and put him in a trailor, with no water or electric available. Dad has a heart cond. and Dr. told brother. Him and my little sister who has taken almost all my dads valuables (she is a drug and alchol adict) and i''m afraid they will get dad out there to let him die for the rest of his land. What can I legally do? I am fighting to keep dad here in Ks. where I can keep watch over him, but he told my older sister he will be driving to Az. as soon as he can. He is totally blind in one eye and he is almost blind in the other. I have been tring to get Dr. to take away his license, but he finds another Dr. to Ok it for another year. What can the rest of us do? There are 5 other daughters and another son that needs to be considered. I am furious that my brother did this behind my back.

Re: Parents land and will

You may need to petition to become guardian. There are many fine lawyers in Ks that can asist you in this endeavor. If you feel that he will risk his life and those other people on the road, then start this before he leaves for AZ.

You may be able to have the designation o fland set aside due to incpacity, but it is a long stretch under teh facts you describe.

Good luck.
