Legal Question in Wills and Trusts in Kansas
purchasing real estate
We signed a contract with a couple, to purchase a
real estate property for said amount. It has been
15 months since the agreement was signed. The
court ordered this couple to sell the real estate
to us. We said we want to buy it for said amount.
we went to the bank and are waiting for the
signed title to complete the loan. This couple
has an attorney that is filing in court that we
are in default of the contract and need to be
evicted from this real estate. We have paid rent
every month which was to be subtracted from the
said sale amount. Can they have us evicted? The
court ordered them to sell us the house and that
is what we told them we will do.

Re: purchasing real estate
You need to contact a real estate attorney. If you have a court order it needs to be enforced. If the other party has filed papers to show you are in default, you must have a good defense. This does not sound like a good thing to defend yourself. Based on the facts which you related you should be able to get this matter resolved favorably, but it also appears that the other side must have some sort of facts which they think may give them a chance in court. Get help.
