Legal Question in Wills and Trusts in Kansas

Time limit on reading a will

My mother passed away in November 2006. Her will has not been read yet and my sister and I do not agree on some issues. My question is: Is there a time limit for reading a will?? I am waiting for my sister to inform me on things, but she is not. I would like to know the details in the will and would like to know if I can have this read by an attorney. Thanks.

Re: Time limit on reading a will

A will is just a piece of paper until the probate court says it is someone's will. "Reading the Will" happens in Hollywood movies. There is limited time in which a will may be submitted to the Probate Court. If your sister holds what you believe to be your mother's last will, then you may need to Petition the Court to open an estate for her. You may be able to do this by applying to be the Executor or Personal Representative of the Estate.

Find an attorney who practices in the county where your mother lived when she passed, or where her real property is located. They may be able to more fully explain the process. You have a limited time in which to open an estate, so do not delay.

Good Luck
