Whether a physical injury or emotional distress resulting from sexual harassment constitutes an injury compensable under the workers' compensation statute, and if so, is workers' compensation the exclusive remedy?

This response is not legal advice nor does it create an attorney-client relationship. In Kansas there is no recovery for psychiatric problems unless there is a physical injury. If there is a physical injury and psychiatric problems flow from that injury, work comp is the exclusive remedy. There is a notice requirement, a written claim requirement and a filing of a timely application that must be done within deadlines to preserve a claim. Jim Wright
