Legal Question in Workers Comp in Kansas
Injured husband: What rights do we have?
My husband was injured at work and they are not giving him the medical attention he needs. Paper work has been altered slightly and the doctors involved are telling different stories. We are unsure as to what we should do. He is on light duty at work, which is fine, we just want his injury fixed as it is now becoming more of a hassle at home as well. He has to take our van to work because he can't drive the stick shift due to his injury and that is an inconvience for our 3 children since they can't go in the other car. The injury took place 3 weeks ago and they have yet to refer him to a specialist and are simply saying nothing is wrong with him. The doctor told his boss '' he simply has a low tolerance for pain.'' He is on crutches because he is unable to walk which continues to result in complications at home with our 3 children because I am in college and he can not be here with the kids alone. We are unsure if we are able to contact an attorney at this point and if it would do any good. The reason we are thinking of this is because we are getting the run around and no one is able to help us. We think possibly an attorney may be able to get the BANKRUPT company to give this the attention it deserves.

Re: Injured husband: What rights do we have?
Your husband's situation seems to be screaming for an attorney. As a concept, Worker's Compensation was meant to be doable without an attorney. Hopwever, the employer's WC insurer has an attorney advising on every case. If your husband does not have an attorney working on his side, he is likely to continue getting the run around.
