Legal Question in Workers Comp in Kansas
What to do
I was injured at work in April. I am a federal employee with the VA, for almost 13 years. I went to my physician. I was diagnosed with 2 protruding disc which are pressing on nerves in my back, and degenerated disc disease. I told them it was a work related injury, but my insurance was billed. I turned in all my medical documents to my immediate supervisor and personel office. I received something from my job saying I need to come back to work on light duty. Both physicians said if I do, it will be against medical advice. I called the Dept. of Labor about my workman comp and being paid since my COP time was running out. I've been getting the run around. They took all my AL & SL now I am on LWOP status. The specialist wants me to have a mylogram, so they can decide about surgery. The Dept of Labor said it was o.k. now they are refusing it. They are forcing me into a position to go back to work. I have no income. I am in severe pain and afraid to injure myself worst. If I go back to work, that cancels my case and I will be responsible for all my medical bills. Already spent money on medicines, lumbar pillows, heating pads and ect. I have pain medicine that I can't afford. What should I do? Go back and risk further injury? or wait?

This reply does not create an attorney client relationship, nor is it to be construed as legal advise. The question you have involves federal law. I do not handle federal workers compensation claims. I suggest you contact the firm of McCullough, Wareheim and LaBunker here in Topeka for possible assistance. I believe they do handle cases like yours. Their phone is 785-233-2323. I hope this response has been helpful. Jim Wright.
