Legal Question in Workers Comp in Kansas

I work out of my home, in the state of CT, for an employer based in KS.

I sustained an on-the-job injury while in KS and am currently unable to work.

Which state's "wage replacement" schedule (KS or CT) should be followed while I cannot work?

Thanks...

You can certainly file a claim in the State of Kansas, since you were injured in the State of Kansas. If CT law allows, you may be able to file a claim there instead, i.e., you could choose the state that allow the highest benefits. I would consult an experienced workers compensation attorney in both states and ask them to coordinate on which state you can file in and which has the best benefits for your situation. I can help you with the Kansas claim and also contact a competant CT attorney, if you wish. There is no charge for our initial consultation, as with most workers compensation attorneys. In Kansas attorney fees in workers comp cases are 25% of the amount recovered, as set by state law. Good luck.
