Collection of Debt

We received a Civil Summons for collection on a credit card. We had 20 days to respons. We did respond before the 20 days with a request for documentation of the debt, as we have not found anything in our records that correspond with the account number. After 60+ days we received a Notice of Service of Plantiff's Interrogatories,Request for Production and Requests for Admission. We did not receive our request for documentation of this debt. Do we legally have to answer the Interrogatories? Thank You

You have 30 days from the date you received the Interrogatories, Request for Production and Request for admission to answer them. If you do not respond, all the admissions will be "deemed admitted" by the court. That means you have effectively admitted everything. You must either admit, deny, or state a valid reason why you can neither admit nor deny their admissions.

You must also provide answers to their interrogatories and request for production of documents. I strongly recommend you contact an attorney to assist you with this. By failing to respond, you may be waiving rights you might otherwise have.
