Civil Judgment

I have a civil judgment against me regarding an unsecured credit card debt. Can they take the money that is in my checking account?

The next step is for them to begin collection proceedings which can include garnishing wages or attaching bank accounts. If you qualify, a bankruptcy can halt that process and possibly discharge this debt.

Yes. If they have a civil judgment for you and it is either ten days after the judgment is entered or the judgment says something like "for which execution shall issue forthwith", the creditor can cause a "Non wage Garnishment Order" to be sent to the bank freezing and ultimately seizing your money (if you are not able to show that the funds are exempt). A bankruptcy filing would, of course, stop them from being able to execute on the judgment.
