Thanks you for taking the time to read my e-mail. It's a long story so I'll try to be brief as possible.
Due to terrible advice from our lawyer we lost our business of 5 years and All the money and credit we had in the world. We don't have the finds to ''fight '' the attorney in court and are bearly making ends meet in a small apt. in Florida. We spoke with an attorney and he wants $900.00 in front to take our bankruptcy case. This is ridiculous since we have no money and that which we do make is just ''keeping our heads above water'' ! Another note , the attorney gave us advice that we could use some money in trust for my nephew from my father...found out this was ''WRONG' and I could be brought up on fraud charges ! Both our attorney and one of his partners lent us money ay high interest rates as operating capital was needed during a couple of ''down- times'' during our season. Any way WE ARE IN BIG TROUBLE , wouldn't you say ? What do you suggest we do ? We are at our wits-end ! Any help would be greatly appreciated.

The reply from Ms. Stickel-Martinez should be followed. You consult with another atty to see if you have a mal-practice action. Another alternative is file a grievance with the Florida Bar.

I understand your situation and you have a very good question. But you have to understand that the court charges $200.00 to file the case and the attorney has alot of documents to prepare and must attend a hearing before the Trustee. Plus having an attorney handle the bankruptcy is a good idea since you want to make sure you receive the exemptions that you are entitled to so that you can keep assets. You can try contacting the Florida Bar and ask if they know of any attorneys willing to handle this case pro bono (free) or file on your own.
