Legal Question in Bankruptcy in Kentucky

Before filling for bankruptcy

Sould I go ahead and notify bank, credit cards, etc that I am going to have to file bankruptcy because I am unemployed and have no money left.

It probably does not make much difference. A lot of people tell creditors that they are filing bankruptcy, but the creditors generally will not stop collection attempts until either the bankruptcy is actually filed or they have contact with a lawyer who tells them that he/she represents the debtor and will be filing a bankruptcy petition for them.

Creditors frequently asked me if I have been "retained" or "fully retained" when I tell them I represent a debtor about to file bankruptcy. They want me to tell them whether I have been paid. I do not consider that to be any of their business -- my ethical obligation to my client arises (in my opinion) when I agree to represent them, not when the check clears....
