Legal Question in Bankruptcy in Kentucky

Re-open Chapter 7

Discharged Chap 7 11/2004 Found out several bills, mostly medical were not included in Chap. 7 (no asset). Can I really have it re-opened to amend the schedule to include those debts? Keep reading conflicting information. Help - thank you

Re: Re-open Chapter 7

You may well be able to re-open your bankrutpcy, but there is probably no need to do so. In no asset Chapter 7 bankrutpcies, which I assume yours was, mistakenly omitted creditors ARE discharged in the bankruptcy UNLESS they have a non-dischargeability claim, such as a claim you procured the credit through fraud. It seems unlikely that your medical bills were procured by fraud.

Send them a copy of your bankruptcy notice and discharge and tell them to leave you alone. Send it Certified Mail, Return Receipt Requested, so that if they continue trying to collect the discharged debt, you will have some options on how to handle them. Good luck.
