I recently purchased a new vehicle with a trade in. The car lot has not paid of my trade in and I bought the car a week ago. I called them and all they said was they hadn't got to it yet. Now I am short $200.00 because the bank will not give me a full refund of my previous payment. What can I do to ensure that I will get my money back? No one seems to be cooperating with me. The man at the car lot knew when my payment was due and told me not to worry about that he would take care of everything. But he didn't. Can you tell me how to deal with this problem because I am not sure.

The first thing to determine is whether you have anything in writing that shows how much he agreed to pay on the trade-in and whether there is a written contract saying when payment would be made.

Next, does the Better Business Bureau have a presence in your city or town? If so, contact them and file a complaint.

I would not wait very long, however, before going down to your district court and talking to the clerk there about how to file a small claims court complaint. If you do file a complaint, be sure to ask for court costs as one of the damages.
