can a restaurant charge gratuity on the full price instead of the discounted price

As a Franchise Attorney I must say I don't understand your question. Restaurants don't charge a gratuity; the customer decides whether to leave a gratuity or not, based on the service. Either repost your question or consult with a good business or franchise attorney in your area for specific advice.
